Hiring foreign personnel who do not live in Curaçao is permitted by the government if certain laws and regulations are met. One of the most important requirements is that the license or statement has been applied for by operation of law and in some cases granted.
As a company, you must distinguish between a work permit and a declaration by operation of law. You do this on the basis of the nationality of the foreign employee.
Dutch or American nationality: In this case, the employee must request a declaration by operation of law and may start work before a decision has been taken on the application.
Other nationality: Employees with a nationality other than Dutch or American always need an assigned residence permit. A residence permit can only be applied for once the work permit has been granted.
You as the employer must first apply for a work permit for this employee. If this application is approved, the employee can apply for his or her own residence permit.
The process of a work permit in combination with a residence permit takes approximately 8 months.
