A Not Applicable statement indicates that the Aliens Act does not apply to a person. This means that the application process for a residence permit in Curaçao works differently for this person. 

There are separate rules for this, but a specific group of people are eligible for this.

Is a declaration of non-applicability required?

The National Ordinance on Admission and Expulsion (LTU) states that every foreigner who wants to be admitted to Curaçao must be in possession of a residence permit issued by the government.

Anyone subject to Article 1, especially persons subject to Article 1c LTU, must obtain a statement that the LTU does not apply to them. This declaration of inapplicability applies to all islands within the Kingdom of the Netherlands. This category of persons can only be registered in Curaçao upon presentation of a Not Applicable Declaration.

If you belong to this target group and you want to come and live in Curaçao (again), you will therefore have to apply for a non-applicable declaration.

Am I eligible for a non-applicable declaration?

You are eligible for a declaration of non-applicability if one of the following situations applies to you: 

  1. You were born in Curaçao and have had Dutch nationality since birth.
  2. You have Dutch nationality and were born in Aruba before January 1, 1986 and lived in the Netherlands Antilles on January 1, 1986 and lived in Curaçao before (on) October 10, 2010.
  3. You have Dutch nationality and were born on Bonaire, Sint Maarten or Sint Eustatius before October 10, 2010 and lived in Curaçao on October 10, 2010.
  4. You are a child of one of the above persons.

It is important to know what costs are involved in this statement. These are costs that are not covered by the CuraBon package. 

fees: These are the administrative costs charged by the Admissions Committee of Curaçao, only for processing the application. The legal fees for a Declaration by operation of law based on a declaration of non-applicability are 225 ANG (Gulden – currency Curaçao).

Document costs: There are costs associated with obtaining the necessary documents, such as a birth certificate, etc. These costs vary depending on where you obtain the documents.
